IHDR on Hiatus

Hey kids -

Sorry we haven't written in a long time. It's been a slow summer and there hasn't been a lot to write when it comes to the DR.

We'll be back when things get busy again - feel free to keep sending us your tales of woe and we'll collect them for the re-launch.

i dont believe i had to wait an hour for my prescription to be filled at the 250 broadway store,never had to wait that long. Stupid Pharmacist think her name was cathy.

yeah you know I've been to that store too and that phatrmacist is nuts.dropped off a prescription and when I came back it still was'nt ready. So I took it back, boy is she slow. She had Dark hair and glasses, kinda goffy looking . Where do they find these nuts.

wow this site is great, I was reading all of the comments and man thats the same store I went to.That pharmacist is very slow, dropped a prescription off in the morning and when I came back in the afternoon it still was'nt ready. Whats up with that. oh the Store is on broadway and park place.

This blog is quite interesting. I recently visited New York and learned very quickly that all the Duane Reade stores don't have registers to charge debit with cash back. They just point you to the Chase ATM so I can fork over $2 for the ATM fee and another $2 from my home bank.

At least the Rite Aid a block away has the cash back feature so I can get a pack of gum for $1.25 and no service charges.

SEC Charges Former Duane Reade Executives with Accounting Fraud
FOR IMMEDIATE RELEASE

Washington, D.C., Oct. 9, 2008 — The Securities and Exchange Commission today charged two former senior executives at Duane Reade with fraud for orchestrating multi-million dollar accounting schemes that caused the company to inflate its reported earnings and overstate its net income. Duane Reade is the operator of the largest chain of drug stores in the New York Metropolitan area.

The SEC's complaint, filed in federal court in Manhattan, alleges that the former Duane Reade executives entered into a series of fraudulent transactions designed to boost reported income and enable the company to meet quarterly and annual earnings guidance. According to the SEC's complaint, the fraudulent transactions were designed by the company's former CEO, Anthony J. Cuti, and primarily implemented by its former Real Estate Administrator and one-time CFO, William J. Tennant.

"This case demonstrates that pursuit of accounting fraud continues to be a priority of the Commission, which will hold corporate officials accountable for misconduct," said Scott Friestad, Deputy Director of the SEC's Division of Enforcement.

Andrew M. Calamari, Associate Director of Enforcement in the SEC's New York Regional Office, added, "The Commission is committed to taking action against corporate executives who fraudulently seek to manage earnings, whether through sham, round-trip transactions as alleged in this case, or other means."

The SEC's complaint alleges that the earnings inflation scheme lasted from 2000 through 2004, and involved two kinds of transactions: the "Real Estate Concession" transactions and the "Credit and Rebilling" transactions. The Real Estate Concession transactions involved payments to Duane Reade for its agreement to relinquish purportedly valuable leases or other real-estate rights. The complaint alleges that these agreements were in reality a sham and that most transactions involved round-trip payments in which Cuti persuaded counterparties to make payments to Duane Reade in exchange for his promise to repay them through other fictitious transactions. The complaint further alleges that Tennant prepared the false documentation used to implement the scheme.

In the Credit and Rebilling scheme, Cuti allegedly engineered different round-trip transactions that he designed to produce additional current income. The SEC's complaint charges that, at Cuti's direction, Duane Reade vendors issued bogus credits to the company that were booked as a reduction to current expenses, resulting in a corresponding increase to current income. However, Cuti also directed these vendors to rebill Duane Reade for the credited amount in later periods under fictitious invoices. Accordingly, when Duane Reade later paid the vendors for phantom services, the fictitious credits were reversed. To disguise the connection between the invoice payments and the original credits, and to ensure that the payments could be capitalized and amortized, rather than charged against current income, Cuti allegedly had the vendors submit the fictitious invoices for work performed on a construction or maintenance project different from that on which the vendor had issued the credits.

According to the SEC's complaint, these schemes together caused Duane Reade to overstate its pre-tax income by a total of approximately $17.5 million. To assure the success of the Real Estate Concession scheme in inflating reported income, Cuti and Tennant are alleged to have intentionally deceived the company's CFO and other members of management. Cuti also allegedly made false statements and omitted material facts in conversations with and written representations to the company's independent auditors as to the true nature of the Real Estate Concession and Credit and Rebilling transactions.

The SEC seeks a final judgment permanently enjoining both Cuti and Tennant from future violations of the antifraud and other provisions of the federal securities laws and ordering them to pay civil penalties and disgorgement of ill-gotten gains with prejudgment interest. The SEC also seeks a judgment barring them from serving as officers or directors of any public company.

The SEC acknowledges the assistance of the U.S. Attorney's Office for the Southern District of New York and the Federal Bureau of Investigations in this matter.

This is a copy of an email I just sent to Duane Reade. THEY SUCK!

"I just visited your 57th street and 6th Avenue location in New York City to pick up a prescription and buy other items. The cashier who checked me out downstairs at the pharmacy was rude, abrupt and obnoxious - behavior that was completely unprovoked. There were three registers to check-out, none of which were manned. One had a sign that said register closed so I placed my items on one of the other counters. After a bit of a wait, the cashier finally came over, didnt look at me, and gathered up all of my items and moved them to the other one and said in a loud, rude voice, This register is closed! I apologized and said there was no sign at that one, only at the other. She rang up my items and when I questioned why my prescription was ringing up a very large amount, she exhaled loudly and told me that I probably had a deductible. I said I had never paid one before (this was my first time this year getting a script) so she picked up my prescription, held it in the air to the pharmacist and yelled, "Can you check this for a deductible! She said she never paid one before and doesnt think she has to pay." The pharmacist confirmed I had one and I said OK and paid my bill.

I dont understand why this cashier was so annoyed and quite frankly, I felt embarrassed and annoyed when I absolutely shouldnt have. The girl works in the pharmacy and should expect questions like the one I had about my deductible. I will be taking my business elsewhere so I never have to deal with this awful type of customer service again."

You HAVE to get back to this blog! I've had so many ridiculous Duane Reade experiences, I could write a book about them. The Duane Reade on W. 72nd btwn Broadway and West End is ridiculous, as they all are. It's like they go out of their way to hire the kids with the worst attitudes.

One time I witnessed a cashier at the photo area, who was talking on his cell phone, stack a bunch of boxes on the counter in front of him in order to hide himself from view of customers when the line got long. I will always regret not walking up to him and knocking the boxes down.

Recently, I was pushing a shopping cart down an aisle, and an employee sucked her teeth at me and glared at me, b/c I was in HER way. She was just hanging out in the middle of the aisle, doing no work, and she refused to budge when she clearly saw me coming down the aisle w/ a cart full of items. I actually said, "You have to be kidding me," and she acted like she was going to beat me up - but she was of course all attitude and no action. Ha ha. DR employees are so full of shit. Sad life when you feel the need to engage in pointless power struggles with random customers. Then again, it's basically just like the sidewalks in NYC. I think they just hire kids off the street who hang out there after they age out of high school.

Then again, having worked in NYC's public high schools, I get why these kids turn out like this.
